SkiPhoria Terms of Use

The agreement between you and the person who makes SkiPhoria.

Read section 2 properly. It is about your health, and it is the part of this document that actually matters. The rest is the ordinary business of who owns what, how you treat the other athletes here, and what happens when something goes wrong.

1. Who you are agreeing with

SkiPhoria is made and operated by Anders Lassen Kamsvaag, an individual developer based in Norway. In this document "we" and "us" mean that person, and "you" means you.

By ticking the boxes when you first open the app, you agree to these terms and confirm you have read the Privacy Policy. If you do not agree, do not use the app.

You must be at least 16 years old to use SkiPhoria. This matches our Privacy Policy, and it means we do not knowingly hold data about anyone younger.

2. Your health, and how hard you train

SkiPhoria is not medical advice. It is not a medical device, it does not diagnose anything, and nothing in it is a substitute for a doctor. Heart-rate zones, the FTP training anchor, calorie figures and suggested power targets are estimates calculated from your own past sessions. They are training tools, not clinical measurements, and they can be wrong.

Talk to a doctor before you start if you have any reason to think hard exercise might not be safe for you — particularly if you have a heart condition, chest pain, high blood pressure, a family history of heart disease, an injury, or you are pregnant, or you take medication that affects your heart rate.

Stop immediately if you feel chest pain, dizziness, faintness, unusual breathlessness, or pain of any kind, and get medical help.

SkiPhoria is built around competition. Pace partners, leaderboards, live racing and power targets are intended to encourage high-intensity training, and many people find they work harder in a race than they would alone. You decide how hard you go. You are responsible for choosing an effort appropriate to your fitness and health, for warming up, and for stopping when you should.

You are also responsible for your equipment: that your ski ergometer or other machine is in good working order, correctly set up, and safe to use, and that the space around you is safe.

What you confirm

When you tick the health box in the app, you are telling us this:

I am healthy enough for vigorous exercise. I do not have a heart condition, chest pain, high blood pressure, or a balance, bone or joint problem that makes hard exercise unsafe — or a doctor has cleared me to train. If I am pregnant, I have my doctor’s clearance.

If that is not true of you, do not tick the box and do not use the app. We may refuse or withdraw access where this confirmation was untrue.

3. Your account

You can use most of SkiPhoria without an account. If you do sign in, the account is yours alone — one person per account. Keep your sign-in secure, give accurate information, and tell us if you think someone else has access to it.

If you turn notifications on, we send them to your device for the kinds you choose — a follow request, a fist bump on one of your sessions, news about an event you host or have joined. Each kind has its own switch in Settings, and your phone's own settings can silence all of them. A notification carries a racer name and what happened, never your numbers and never your heart rate.

4. Fair play, and how you treat other athletes

Leaderboards only mean something if the times on them are real. You must not falsify results, tamper with the power data your machine reports, use software to simulate an effort you did not make, or share an account so that someone else's session appears as yours.

We may remove or mark any result, and suspend or close any account, where we believe this has happened. Results are automatically checked against limits of human performance before they are published, and a result outside those limits is rejected or flagged.

The people around you on a leaderboard, in a live room or in an event are real. Do not harass, threaten or demean anyone, do not impersonate anyone, and do not use a racer name, a course name or anything else you publish to do those things.

Report. Next to another athlete's name, race, course or lobby entry there is a Report button. Use it for a name, a result or a route that breaks these rules or infringes your rights, and tell us why. A person reads every report. We may remove content or results, mark a result as unverified, rename an account, or suspend or close an account, and we will tell the reporter what happened where we can. We do not screen content before it appears, and we may decide that a report does not need action.

Events you organise. Anyone with an account may create a private or unlisted event and invite others by link. The organiser sets the course, the window and the rules, and may remove an entrant from their own event. That is the organiser's decision, not ours: we do not arbitrate it, and being removed says nothing about the athlete's result, which stays in their own history and on the ordinary course leaderboards. Public, official events are created by us.

5. Acceptable use

Do not reverse engineer the app, interfere with it or with our servers, access it by automated means, or scrape data from it. Public leaderboards are published so athletes can compare themselves with each other, not so they can be harvested in bulk.

6. Courses and names you upload

You keep ownership of anything you upload, including routes you import from a GPX file. When you choose to share a course, you give us permission to store it and to make it available to the other athletes you share it with. That permission lasts as long as the course is shared, and it survives the deletion of your account — other people's races on it would break otherwise — but your name and the route's real location are removed from it when your account goes. It exists only so that sharing can work; we do not use your courses for anything else.

You confirm that you have the right to upload what you upload. A GPX file may be someone else's work, and route data can carry its own rights.

Racer names are public. Do not use a name that impersonates someone else, infringes a trademark, or is offensive. We may change or remove such a name.

If you believe something on SkiPhoria infringes your rights, use the Report button on it, or write to support@skiphoria.com. We will look into it and remove it where appropriate.

7. What belongs to us

SkiPhoria — the app, its name, its artwork, its software and the courses we publish ourselves — belongs to us or to the people we license it from. You get a personal, limited, revocable licence to use the app. That licence does not let you copy it, sell it, or build something else out of it.

8. Other companies' services

SkiPhoria works with services we do not control: Strava, Supabase, Apple, Google, Expo, Sentry and Cloudflare. The Privacy Policy says what each one does for us. Your use of those services is governed by their own terms, and we are not responsible for what they do, for their availability, or for what happens to data once you have asked us to send it to them.

9. Virtual results are not real-world results

Every session in SkiPhoria happens indoors on a machine. When a session is uploaded to Strava, the route is written with deliberately fictional coordinates placed in the empty Southern Ocean, far from any land, so that an indoor effort can never appear on a real-world segment leaderboard alongside people who actually skied outside.

You must not present a SkiPhoria result as a real-world performance, or edit an uploaded activity so that it appears to be one.

10. Parts that are still experimental

Some features are provided as they are and may be inaccurate, may change, or may be withdrawn. The physics that turns your power into speed on a virtual course is versioned: when we improve it, results made under the old version and the new one are ranked separately, so a time is only ever compared with times made the same way. The automatic detection of which kind of machine you are on has not yet been verified against every machine on the market. Do not rely on any of this for anything that matters.

11. Availability, and your data

SkiPhoria is run by one person. We do not promise that it will always be available, that it will be free of errors, or that it will continue to exist. We may change it, or stop offering it, at any time.

Some things live only on your device: your maximum heart rate, your heart-rate recordings and your device settings. Heart rate leaves the device only if you switch that on for Strava or for a file you export yourself — see the Privacy Policy. If you uninstall the app, reset your device, or lose it, those are gone and we cannot restore them. Your races, workouts and free-ski sessions are kept in your account while you are signed in and come back when you sign in again — without their heart rate, which is never stored in your account.

12. No warranties, and a limit on what we owe you

SkiPhoria is provided "as is". To the extent the law allows, we make no warranties about it — in particular no warranty that it is accurate, uninterrupted, or fit for any particular purpose.

To the extent the law allows, our total liability to you for all claims taken together is limited to the greater of NOK 500 or the amount you have paid us in the twelve months before the claim arose.

13. What this does not limit

Nothing in these terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be excluded or limited.

Nothing in these terms affects your rights under Norwegian and EEA consumer law, or your rights under data protection law, including any right to compensation under the GDPR. Where these terms conflict with a right you have by law, the law wins.

14. If we are sued because of you

If someone brings a claim against us because of something you uploaded, or because you used SkiPhoria in a way these terms do not allow, you agree to cover the reasonable costs of dealing with it. This does not apply to anything that is our fault.

15. Changes to these terms

We may update these terms. If a change is material, the app will ask you to accept the new version before you continue using it — we do not treat carrying on using the app as silent agreement to something you have not seen. Minor corrections are published here with a new date.

16. Ending it

You can stop using SkiPhoria whenever you like, and you can delete your account and everything in it from inside the app: Profile → Settings → Delete account.

We may suspend or close an account that breaks these terms. We may also close an account that has not been signed in to for 24 months, so that we are not holding data nobody is using; we will email the address on the account 30 days before we do.

17. Which law applies

These terms are governed by Norwegian law, and disputes may be brought before the Norwegian courts.

If you are a consumer in the EEA, this does not take away your right to rely on the consumer protection law of the country you live in, or to bring a case there. You can also contact the Norwegian Consumer Authority (Forbrukertilsynet) about a complaint.

18. If you installed from the App Store

These terms are between you and us, not between you and Apple. Apple is not responsible for SkiPhoria or for its content, and has no obligation to provide any support for it. If the app does not work as it should, you may tell Apple, and Apple may refund the purchase price, if any — beyond that, Apple has no other warranty obligation. Any claim about the app, including a claim that it infringes someone's intellectual property, is our responsibility and not Apple's. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm you are not in a country subject to a US embargo or listed as a prohibited party, and that you will comply with any third-party terms that apply when you use the app.

19. What it costs

SkiPhoria is currently free. If we introduce paid features, the price and the terms that apply to them will be shown before you buy anything, and nothing you already have will start costing money without your agreement.

20. General

If any part of these terms turns out to be unenforceable, the rest still applies and only that part is set aside. Not enforcing something straight away does not mean we have given it up. These terms, with the Privacy Policy, are the whole agreement between us. You may not transfer your rights under them to someone else. Neither of us is responsible for a failure caused by something genuinely outside our control. We may contact you by email at the address on your account.
